By submitting your phone number and email you are providing express written consent for this company, its affiliates, agents, and service providers to contact you at that number regarding products or services, including via autodialed and/or prerecorded or artificial voice calls and text messages (SMS and MMS), or email even if your telephone number is a cellular number or on a corporate, state, or the National Do Not Call Registry (DNC) or other do not contact list. You may opt-out at any time by emailing us a Do Not Call Request. Your consent is not required or a condition of any purchase. Message and data rates may apply. You also consent to our SMS terms, Privacy Policy, and Terms of Use. By communicating with us by phone or email, you give your full consent for any and all calls, texts, and emails to be recorded for quality and training purposes.

Mira Science, LLC (“Mira Science, LLC,” “we,” “our,” or “us”) understands that your privacy is important to you. Mira Science, LLC provides AI-powered software for laboratory diagnostics, including plate reading, colony counting, and related analytical workflows. We are committed to protecting the privacy of your personally identifiable information as you use our website and software application (collectively, the “Site” and “Software”). This Privacy Policy explains how we collect, use, and protect information gathered from you and from your organization’s use of the Software. By using the Site or Software, you consent to the terms described in the most recent version of this Privacy Policy. You should also read our Terms of Service to understand the general rules about your use of the Site and Software. “You,” “your,” “visitor,” or “user” means the individual or organization accessing the Site or Software.

Personal and non-personal information

This Privacy Policy identifies how we treat your personal and non-personal information, as well as Lab Data generated through your use of the Software.

What is non-personal information and how is it collected and used?

Non-personal information is information that cannot identify you. If you visit the Site to read information, such as information about one of our services, we may collect certain non-personal information from your computer’s web browser, such as browser type, operating system, referring URL, and aggregate usage statistics. Because non-personal information cannot identify you or be tied to you in any way, there are no restrictions on the ways that we can use or share non-personal information.

What is personal information and how is it collected?

Personal information is information that identifies you as an individual, such as your name, business email address, mailing address, telephone number, job title, and organization. We may collect personal information from you in a variety of ways:

  • When you fill out a contact, demo request, or registration form on the Site.
  • When you create an account in the Software or are invited to one by your organization.
  • When you communicate with us by email, phone, or through customer support channels.
  • When you enter into a Beta Test Agreement, Subscription Agreement, Order Form, or other commercial arrangement with us.
  • When you participate in surveys, webinars, or marketing programs.
  • When we collect information about you in support of a transaction, such as billing contact information (payment card details are handled by our payment processors, not stored by us directly).

Lab Data and Software-Generated Information

When you or your organization uses the Software, we collect and process the following categories of data (collectively, “Lab Data”):

  • Plate images captured through the Software.
  • AI analysis results, colony counts, pass/fail determinations, and other analytical outputs.
  • Sample or batch identifiers, lot numbers, timestamps, and metadata that you or your team enter or that the Software captures during analysis.
  • Usage logs, session data, and feature interaction data.
  • Device metadata (device model, OS version, camera specifications).
  • Error logs and crash reports.

Lab Data is used to: (i) provide the Software’s functionality to you; (ii) improve and refine our AI models and algorithms; (iii) identify bugs, performance issues, and opportunities for product improvement; (iv) analyze usage patterns to inform product development; and (v) provide technical support. Mira Science, LLC will not sell Lab Data, and we will not share Lab Data with third parties except as required to operate the Software (for example, our cloud hosting providers), as authorized by you in a separate written agreement, or as required by law.

You are responsible for ensuring that any samples, identifiers, images, or other data entered into the Software do not include protected health information (PHI), personally identifiable information of patients (PII), or other data subject to regulatory confidentiality requirements (including HIPAA, GDPR Article 9 special category data, or equivalent), unless expressly agreed in writing with Mira Science, LLC under a Business Associate Agreement, Data Processing Agreement, or equivalent. Mira Science, LLC’s standard Software offering is not configured for the processing of PHI or regulated patient data. If your organization requires such processing, contact us to discuss appropriate contractual safeguards before uploading such data.

Where Mira Science, LLC acts as a processor on behalf of your organization (the controller), the parties’ respective rights and obligations with respect to Lab Data are set forth in the applicable Beta Test Agreement, Subscription Agreement, Data Processing Agreement, or Order Form. In the event of any conflict between this Privacy Policy and such a separate written agreement, the separate agreement will control with respect to the subject matter it covers.

Are cookies or other technologies used to collect information?

Yes. We may use cookies and related technologies, such as web beacons and similar tracking technologies, to collect information on the Site. A cookie is a small text file placed on your device by a web server. Cookies cannot be used to run programs or deliver viruses to your device. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie. One primary purpose of cookies is convenience: for example, if you register with us, a cookie helps Mira Science, LLC remember your preferences on subsequent visits. A web beacon is a small graphic image that allows the party that set it to monitor and collect certain information about the viewer of the web page or email message. We may use web beacons to count visitors to the Site or to monitor how our users navigate the Site, and we may include web beacons in email messages to count how many messages sent were actually opened or acted upon.

Third-party vendors may also use cookies on the Site. For instance, we may contract with analytics providers who use cookies on the Site to track and analyze anonymous usage and volume statistical information from our visitors. These third parties use persistent cookies to help us improve the visitor experience, manage our content, and track visitor behavior. All data collected by these third parties on behalf of Mira Science, LLC is used solely by or on behalf of Mira Science, LLC and is shared externally only on an anonymous, aggregated basis. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Mira Science Site.

How does Mira Science, LLC use personal information?

Mira Science, LLC may use personal information we collect from or about you to: provide you with access to the Site, the Software, and our other products and services; respond to your requests and inquiries; bill you for products or services purchased; provide ongoing service and support; contact you with information about our products, services, and updates; ask for your opinion or feedback about our products; perform record keeping, analytics, and security functions; and research, develop, and improve our programs, products, services, and content. Personal information collected online may be combined with information you provide to us through other sources. We may also de-identify your personal information so that you can no longer be identified as a single unique individual; once de-identified, this information is treated as non-personal information. Finally, we may use your personal information to protect our rights or property, to protect someone’s health, safety, or welfare, or to comply with a law or regulation, court order, or other legal process.

Does Mira Science, LLC share personal information with others?

We do not sell your personal information. We will not share your personal information with an unrelated third party without your permission, except as otherwise provided in this Privacy Policy. In the ordinary course of business, we may share some personal information with companies that we hire to perform services or functions on our behalf, such as cloud hosting providers, payment processors, analytics vendors, customer support tools, and email service providers. We require these service providers to treat your information confidentially and to use it only for the purposes for which we engaged them. We will not sell, exchange, or publish your personal information, except in connection with a corporate sale, merger, dissolution, or acquisition, in which case the acquiring party will be bound by terms at least as protective as those in this Privacy Policy. We may be legally compelled to release your personal information in response to a court order, subpoena, search warrant, law, or regulation. We may cooperate with law enforcement authorities in investigating and prosecuting users who violate our rules or engage in behavior that is harmful to others or illegal. We may disclose your personal information to third parties if we believe disclosure is necessary to protect our rights or property, protect someone’s health, safety, or welfare, or comply with a law or regulation, court order, or other legal process.

How is personal information used for communications?

We may contact you periodically by email, mail, or telephone to provide information regarding products, services, updates, and content that may be of interest to you. Some Site features allow you to communicate with us using an online form, and if your communication requests a response, we may send you a response via email. We cannot guarantee that our emails to you will be secure from unauthorized interception. You may opt out of marketing communications at any time by following the unsubscribe instructions in those communications or by contacting us at the email address below. Transactional and service-related communications (e.g., billing notices, security alerts, and material changes to our terms) are not subject to opt-out as long as you maintain an account with us.

How is information secured?

We maintain reasonable administrative, technical, and physical safeguards designed to protect personally identifiable information and Lab Data from loss, misuse, unauthorized access, alteration, or destruction. Only authorized personnel and third-party vendors have access to your information, and these employees and vendors are required to treat this information as confidential. Despite these precautions, no method of transmission or storage is 100% secure, and we cannot guarantee that unauthorized persons will not obtain access to your information. If we become aware of a security incident affecting your personal information or Lab Data, we will notify you and any applicable authorities as required by law and any applicable agreement between us.

Data retention

We retain personal information and Lab Data for as long as necessary to provide the Site and Software, fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Specific retention periods for Lab Data may be set forth in your Beta Test Agreement, Subscription Agreement, Data Processing Agreement, or Order Form. Following termination of your relationship with Mira Science, LLC, we may retain de-identified or aggregated data indefinitely, including for the purpose of training and improving our AI models.

The Site may contain links to other websites that provide information we consider interesting or useful. Mira Science, LLC is not responsible for the privacy practices or the content of such websites. We encourage you to review the privacy policies of any third-party sites you visit.

Public discussions and community features

The Site or Software may, from time to time, provide community features such as forums, customer communities, or discussion areas. Any information you post in these areas may become visible to other participants, so please do not post sensitive information, confidential information, or any information you do not wish to share publicly. We are not responsible for the actions or policies of any third parties who collect information that users disclose in such forums. Mira Science, LLC does not endorse or take responsibility for content posted by users in community areas. You must comply with our other published policies regarding postings.

How can a user access, change, or delete personal information?

You may access, correct, update, or delete personally identifiable information that you submit to the Site or Software. You may also unsubscribe from marketing communications at any time. To do so, please follow the instructions in the relevant Site page or communication, or contact us at support@mirascience.ai. Depending on your jurisdiction, you may have additional rights under applicable data protection laws (including under the California Consumer Privacy Act, the EU General Data Protection Regulation, or similar laws), such as the right to access, correct, port, restrict processing of, or delete your personal information, and the right to lodge a complaint with a supervisory authority. Children’s privacy

The Site and Software are intended for use by laboratory professionals and other business users, not by children. Mira Science, LLC will not intentionally collect any personal information from children under the age of 13. If you believe that we have inadvertently collected personal information from a child under the age of 13, please contact us at support@mirascience.ai and we will take steps to delete such information.

International users

Mira Science, LLC is based in the United States, and your information will be processed in the United States and other countries where our service providers operate. If you access the Site or Software from outside the United States, you understand that your information may be transferred to, stored in, and processed in a country whose data protection laws may differ from those in your jurisdiction. Where required, we implement appropriate safeguards (such as standard contractual clauses) for international data transfers.

Changes

Mira Science, LLC reserves the right to modify this Privacy Policy at any time. Any changes will be reflected in the “Last Updated” date above, and if changes are material, we will provide additional notice (such as a homepage banner or email notification to account holders).
